These Terms of Service govern the use of The Family Crest Company website and the purchase of products from our store. By accessing our website, submitting an order or purchasing a product, you agree to these terms.

1. About Our Store

The Family Crest Company is an independent Canadian business located in Nova Scotia, Canada. We create personalized family-heritage products featuring surnames, crest artwork, tartans, coats of arms and related historical information.

2. Eligibility and Acceptable Use

You may use this website only for lawful purposes. You must not:

• Interfere with the operation or security of the website

• Attempt to gain unauthorized access to our systems

• Use the website to submit fraudulent orders

• Copy, reproduce or commercially exploit our artwork, designs or written content without permission

• Upload or submit unlawful, infringing, abusive or misleading material

We may refuse service, restrict access or cancel an order when we reasonably believe fraud, misuse or unlawful activity has occurred.

3. Product Information

We make reasonable efforts to present our products, colours, dimensions, descriptions and artwork accurately. Screen settings, materials and production processes may cause minor variations in colour or appearance.

Measurements and photographs are provided for reference. Minor variations that do not materially affect the product are not considered defects.

4. Family-Heritage and Heraldic Information

Surname histories, tartans, crests, coats of arms, mottos and other heritage information may vary between historical sources, regions and family branches.

Our products are decorative family-heritage items. They are not genealogical certifications, legal determinations of ancestry or proof that a customer has an individual right to bear a particular coat of arms.

Scottish crest-badge artwork, Irish coats of arms and other heraldic designs are presented according to the design shown on the applicable family page or product listing. Customers should review the displayed artwork before ordering.

5. Personalized Orders

Customers are responsible for reviewing all information submitted or selected with an order, including:

• Surname and spelling

• Nationality or heritage selection

• Crest, tartan or coat-of-arms design

• Product type, size, colour and quantity

• Delivery address

We produce orders according to the selections and information received. Products made correctly according to the order are not considered defective because the customer later prefers a different spelling, design, family association or historical source.

Changes and cancellations are not guaranteed once production has begun.

6. Orders and Acceptance

Submitting an order does not guarantee acceptance. We may refuse or cancel an order because of:

• Incorrect pricing or product information

• Suspected fraud or unauthorized payment

• Product or material unavailability

• An incomplete or undeliverable address

• An unlawful or inappropriate personalization request

• A technical or inventory error

If we cancel a paid order, we will refund the applicable amount to the original payment method.

We may limit quantities or contact the customer for clarification before beginning production.

7. Prices, Payments and Currency

Prices are displayed in the currency selected or presented through the website. Currency-conversion rates may change and may include rounding or conversion adjustments.

Payment must be authorized before an order enters production. Customers are responsible for any charges imposed by their bank, card issuer or payment provider.

Applicable Canadian taxes are calculated according to the order’s delivery destination. International customers are responsible for customs duties, import taxes or related carrier charges unless those amounts are expressly collected at checkout.

8. Shipping and Delivery

Orders are shipped according to our Shipping Policy. Processing and delivery estimates are not guaranteed delivery dates.

Mugs require separate protective packaging and may ship separately from other products. Orders containing products from different shipping profiles may generate separate shipping charges and arrive in multiple packages.

We are not responsible for delays caused by carriers, customs, weather, incorrect addresses or other circumstances outside our reasonable control. This does not limit any rights available under applicable law.

9. Returns, Cancellations and Refunds

Returns, cancellations, replacements and refunds are governed by our Return and Refund Policy.

Personalized and made-to-order products are generally final sale when they have been produced correctly according to the order. Buyer’s remorse or a preference for different artwork does not create a right to return a correctly produced item.

Damaged, defective or incorrect products should be reported promptly with the order number and clear photographs of the product and packaging.

10. Intellectual Property

Unless otherwise stated, the website’s original layouts, product presentations, written descriptions, graphics, compilations and custom artwork are owned by or licensed to The Family Crest Company.

Purchasing a product does not transfer ownership of the underlying digital artwork or grant permission to reproduce, distribute, resell or commercially use our designs.

Historical names, public-domain symbols and traditional heraldic elements may not be exclusively owned by The Family Crest Company. However, our original arrangements, redrawn artwork, product files and presentations remain protected to the extent permitted by law.

11. Customer-Submitted Material

If you provide an image, name, text or other material for personalization, you confirm that you have the right to use it and authorize us to reproduce it solely as necessary to complete your order.

We may refuse material that appears unlawful, infringing, hateful, defamatory or otherwise inappropriate.

12. Third-Party Services

Our website may rely on third-party services for payments, hosting, shipping, analytics or other functions. Those services may be subject to their own terms and policies.

We are not responsible for third-party websites or services that we do not control.

13. Disclaimer and Limitation of Liability

To the fullest extent permitted by law, products and website content are provided without guarantees beyond those expressly stated in these terms.

The Family Crest Company is not liable for indirect, incidental, special or consequential losses arising from the use of the website or products.
